House Bill 258 Summary

• Authorizes amusement parks, gaming establishments with video games and arcade games, fairs and carnivals, and reception/party venues to reopen at 50% fire capacity with COVID-19 safety requirements including daily employee temperature checks, face masks, hand sanitizer stations, and EPA-approved disinfectant cleaning protocols.

• Requires establishments to maintain 6-foot social distancing, provide contactless check-in, post signage, and monitor compliance; employees with fever of 100.4°F or higher are prohibited from working.

• Permits outdoor stadiums with 12,000 or less spectator capacity to operate restaurant food and beverage service in designated indoor and outdoor seating areas limited to 10% of stadium capacity.

• Requires Governor to obtain majority Council of State concurrence before exercising emergency powers to further restrict these establishments, and requires similar approval for health secretaries to order closures for COVID-19 hazards.

• Provisions expire when applicable emergency declarations are terminated, except outdoor stadium restaurant service expires on the later of 30 days after emergency restrictions end or October 31, 2020.
