Persons 21 years of age or older may operate a motorcycle without a safety helmet if they have held a motorcycle license or endorsement for more than 12 months or completed the Motorcycle Safety Instruction Program authorized in G.S. 115D-72 or its equivalent.

Persons 21 years of age or older may ride as a passenger on a motorcycle without a safety helmet if the operator is allowed to operate without a helmet under the above conditions.

All persons under 21 years of age must continue to wear safety helmets that comply with Federal Motor Vehicle Safety Standard (FMVSS) 218 when operating or riding on motorcycles or mopeds.

Violation of helmet requirements constitutes an infraction with a penalty of $25.00, with no court costs assessed.

The act becomes effective December 1, 2019, and applies to violations occurring on or after that date.
