Operating a motor vehicle without financial responsibility remains a Class 3 misdemeanor under G.S. 20-313(a)

Law enforcement must tow and store vehicles when the owner is charged with operating without financial responsibility, using the agency's current rotation system and towing regulations

Vehicle release requires owner to present proof of financial responsibility covering at least six months to the charging agency or prosecuting district attorney, plus payment of all towing and storage fees

Charging law enforcement agency must notify any lienholder within 24 hours of towing, and lienholders may take possession of the vehicle upon payment of towing and storage fees

Owners may petition the court within 10 business days claiming innocent owner status if they maintained financial responsibility, and if granted, the vehicle is released upon payment of storage costs

Act becomes effective December 1, 2019, and applies to charges filed on or after that date
