House Bill 378: Distiller Regulatory Reform Bill

• Allows distilleries to sell malt beverages, unfortified wine, and fortified wine for on-premises consumption by obtaining appropriate permits under existing law.

• Permits distilleries to sell mixed beverages for on-premises consumption in areas where mixed beverages are authorized, without requiring a separate mixed beverages permit.

• Enables distilleries to sell spirituous liquor directly to mixed beverages permit holders and consumers in other states, with distillery permit holders paying one-half of mixed beverages and guest room cabinet surcharges to the Department of Revenue and 5% to the Department of Health and Human Services.

• Revises distillery sales of spirituous liquor to tour visitors by removing commemorative sticker requirement, increasing purchase limits from five bottles per 12-month period, and implementing point-of-sale tracking; also allows distilleries to issue purchase-transportation permits for spirituous liquor.

• Authorizes spirituous liquor tastings at ABC stores where local boards approve, and allows bars to obtain on-premises ABC permits for malt beverages, wine, fortified wine, brown-bagging, special occasion, and mixed beverages.
