NC Constitutional Carry Act (H498) Summary

• Allows any U.S. citizen at least 18 years old to carry a concealed handgun without a permit, effective December 1, 2019, unless otherwise prohibited by law.

• Creates new statute G.S. 14-415.35 establishing disqualifications for concealed carry including felony convictions, domestic violence convictions, unlawful drug use, mental illness adjudications, and certain misdemeanor convictions involving crimes of violence.

• Permits remain available on a voluntary basis for reciprocity when traveling to other states and other purposes; current permit holders retain rights under existing Article 54B.

• Requires persons carrying concealed handguns to carry valid identification and disclose to law enforcement officers upon request that they are carrying.

• Maintains restrictions on carrying concealed handguns in law enforcement facilities, correctional facilities, courthouses, private premises with posted notice, and areas prohibited by federal law or administrative rules.
