House Bill 531 Summary

• Modifies G.S. 45-21.29 to require satisfaction of the federal Protecting Tenants at Foreclosure Act (PTFA), Pub. L. 111-22, Title VII, Sections 701-703, before orders for possession can be issued for single-family residential properties occupied pursuant to a lease.

• Requires occupants covered by the PTFA to receive written notice of the possession application in addition to the standard 10-day notice required under state law.

• Repeals G.S. 45-21.33A, which contained the previous state-specific tenant protections in foreclosure proceedings.

• Takes effect October 1, 2019, and applies to all possession petitions filed on or after that date.
