Prohibits all state agencies, including the Department of Environment and Natural Resources, Environmental Management Commission, Commission for Public Health, and Mining and Energy Commission, from issuing permits for oil or gas exploration or development using horizontal drilling and hydraulic fracturing

Removes language that allowed hydraulic fracturing from regulatory authority and requires the Environmental Management Commission to assess toxic air emissions from drilling operations using these technologies, including truck traffic emissions

Designates the State Geologist as custodian of confidential hydraulic fracturing fluid data and requires the geologist to certify within five days that all fluids comply with state and federal laws before drilling operations can commence

Repeals G.S. 113-415.1 to restore community choice on oil and gas exploration and repeals provisions in G.S. 113-391(a)(5) and G.S. 113-395(b)

Becomes effective upon enactment and applies to all permit applications for oil and gas exploration or development activities received on or after that date
