House Bill 679 Summary

• Requires attorneys to file electronically if electronic filing is available in the county of filing, and permits self-represented litigants who are registered in the electronic filing system to file electronically.

• Allows service of pleadings and other documents through the court's electronic filing system, and establishes electronic mail (e-mail) as an acceptable service method when parties consent or when attorney contact information is on file with the court.

• Specifies that e-mail service to attorneys must be sent by 5:00 P.M. Eastern Time on a business day, with service deemed complete the next business day if sent after that time.

• Requires certificates of service to accompany pleadings and identify the method of service used, including telefacsimile numbers or e-mail addresses for those served electronically.

• Becomes effective October 1, 2020, and applies to all filings and service conducted on or after that date.
