H740 - Ending NC's Involvement in Torture

• Creates two new criminal offenses: torture (Class E felony) and enforced disappearance (Class F felony), with jurisdiction over offenses committed in North Carolina or involving conspiracies formulated or performed in the state.

• Establishes investigative grand jury procedures for torture and enforced disappearance cases that can be convened upon petition by district attorney or Attorney General, with grand jurors serving 12 months and 18 persons selected if additional grand jury is convened.

• Grants Attorney General concurrent jurisdiction with district attorneys to prosecute violations of torture and enforced disappearance laws revealed by grand jury investigations.

• Prohibits state contracting with vendors and funding of non-state entities if any officer, director, or owner has been convicted of torture, enforced disappearance, or related federal/international abduction laws.

• Requires airports receiving state loans or grants to establish and implement policies prohibiting airport use for torture or enforced disappearance activities, and mandates reporting to Department of Justice at least 10 days before transporting persons arrested or detained by federal government.
