Amends G.S. 130A-335(a2) to clarify liability protections for the Department of Health and Human Services, its agents, and local health departments regarding wastewater system failures resulting from evaluations by licensed soil scientists and licensed geologists

Requires evaluations for new wastewater systems or repair projects to satisfy all requirements of applicable articles and remain within the scope of the applicable professional license

Mandates that licensed soil scientists or geologists conducting evaluations maintain errors and omissions liability insurance issued by a Chapter 58 licensed insurer in an amount commensurate with the risk

Upon receipt of a signed written evaluation, the Department, its authorized agents, and local health departments are discharged from all liabilities, duties, and responsibilities arising from soil conditions, site features, geologic conditions, or hydrogeologic conditions covered by the evaluation

Became effective upon enactment, approved July 19, 2019
