Department of Administration shall conduct a study on the availability and utilization of certified historically underutilized businesses (HUBs) in state contracts for construction, professional services, and supplies/equipment.

Study must analyze state procurement laws and practices, the number of certified HUBs, contract awards to HUBs since the 2003 disparity study, and false statements or misrepresentations made by businesses claiming HUB status.

Study must evaluate the state's certification process and database, identify measures to reduce misrepresentation and fraud, and recommend additional policies or programs to increase HUB participation including bid bond assistance and a commission for economic opportunities.

$1,000,000 in nonrecurring funds appropriated to the Department of Administration for the 2019-2020 fiscal year to contract with a private entity to conduct the study.

Department must present study findings and legislative recommendations to the General Assembly, Joint Legislative Oversight Committee on General Government, and Fiscal Research Division by May 1, 2020; act becomes effective July 1, 2019.
