H874 - The Second Chance Act

• Creates new expunction eligibility for juveniles ages 16-17 convicted of Class H or I felonies and misdemeanors (excluding impaired driving and sex offenses) upon completion of sentence and restitution, effective December 1, 2019.

• Grants prosecutors electronic access to confidential expunged files for records expunged on or after July 1, 2018 under specified expunction statutes.

• Streamlines expunction process for dismissed charges and not guilty findings occurring on or after December 1, 2019 by making expunction automatic by operation of law without requiring a hearing.

• Allows expunction of multiple nonviolent misdemeanor or felony convictions with 5-year waiting period for misdemeanors and 10-year waiting period for felonies, eliminating the previous one-conviction limit.

• Eliminates filing fees for juvenile expunctions and requires all state and local agencies to expunge records upon court order.
