NC S151

Creates a new felony offense for breaking or entering a pharmacy with intent to commit larceny of a controlled substance, classified as a Class E felony.

Defines pharmacy as a business with a pharmacy permit under G.S. 90-85.21 and controlled substance according to G.S. 90-87(5).

Makes receiving or possessing a controlled substance stolen from a pharmacy a Class F felony, unless another provision of law provides greater punishment.

Subjects any property acquired or maintained through violation of this offense to forfeiture under procedures in G.S. 90-112.

Becomes effective December 1, 2019, and applies to offenses committed on or after that date.
