Senate Bill 302 Summary

• Authorizes adult care homes to use Medicaid personal care service assessments completed within 35 days of resident admission to fulfill the activities of daily living portion of required service plans or care plans, exempting facilities from conducting separate assessments within 30 days of admission.

• Amends assisted living administrator certification qualifications to require a high school diploma or equivalent, 60 months of supervisory experience (instead of two years of college coursework), or a combination of education and experience approved by the Department.

• Expands North Carolina Board of Nursing disciplinary powers to include multiple new remedial actions such as probation with conditions, public reprimands, public letters of concern, and remedial training, in addition to license denial, suspension, and revocation.

• Creates three new Board of Nursing statutes establishing appeal procedures for licensees, confidentiality protections for Board investigative information, and service of notice requirements for licensing actions.

• Allows the Board of Nursing to waive licensing requirements during declared emergencies to permit emergency health services, and requires licensees to self-report felony arrests, DWI arrests, and controlled substance arrests within 30 days.
