Department of Health and Human Services must request a waiver from the USDA by October 1, 2020, to prohibit SNAP benefit purchases of foods with little or no nutritional value, including soft drinks, candy, cakes, and cookies that are subject to state sales tax.

State must also seek waiver authority to prohibit bulk purchases of grocery items that would be considered prepared food if bought in smaller quantities and are subject to state sales tax.

Division of Social Services must amend its rules within 60 days of USDA waiver approval to implement prohibitions on the specified food purchases.

Division must report to the Joint Legislative Oversight Committee on Health and Human Services within 30 days of the USDA's decision to either grant or deny the waiver request.

Act is effective upon enactment into law.
