Department of Commerce may not contract with nonprofit corporations to administer federal government funds, except for the State Trade and Export Promotion Program and Manufacturing Extension Program.

Department of Commerce may not contract with nonprofit corporations to administer a site certification program, but may contract for creating or maintaining a website displaying data on unutilized or underutilized properties.

Governing board of contracted nonprofit corporation increased from 17 to 18 voting members, with Secretary of Commerce serving as ex officio member and eight members appointed by Governor, four by House Speaker, and four by Senate President Pro Tempore.

Contract renewal term limited to no more than three years, with extensions not exceeding four years total, and Department must provide notice of renewal intent at least five months in advance for initial renewals and one year in advance for subsequent renewals.

Nonprofit corporation must raise at least $750,000 in the first year and $1,250,000 in each subsequent year from sources other than State funds to support operations.
