Senate Bill 769 Summary

• Allows cities to lease portions of city-owned public enterprises for wired or wireless network operations without voter approval, subject to Article 12 regulations.

• Authorizes cities and counties to purchase, lease, construct, and operate facilities for internal governmental communications, including wired or wireless network facilities.

• Expands the definition of "public-private projects" to include capital improvement projects involving construction of wired or wireless network components in conjunction with other construction projects, but prohibits unilateral city or county provision of broadband service.

• Appropriates $50,000 in nonrecurring funds to the Department of Information Technology's Broadband Infrastructure Office for fiscal year 2020-2021 to assist local governments in planning and implementing broadband infrastructure expansion.

• Effective upon becoming law, except the appropriations section becomes effective July 1, 2020.
