House Bill 1005 - Organized Retail Theft

• Increases penalties for organized retail theft to Class H felony ($1,500+ value over 90 days), Class G felony ($20,000+), Class F felony ($50,000+), and Class C felony ($100,000+) aggregated over a 90-day period.

• Creates new offenses for damage to property ($1,000+) and assault during organized retail theft, both punishable as Class A1 misdemeanors.

• Allows retail property owners to seek civil damages including consequential and punitive damages with no maximum limit for organized retail theft, and allows property seizure to be returned prior to trial upon court order with photographic evidence substituted.

• Requires online marketplaces to collect and verify identifying information from high-volume third-party sellers (200+ transactions or $5,000+ in revenue within 12 months) within 10 days of qualification.

• Mandates online marketplaces disclose seller identity information to consumers for high-volume sellers with $20,000+ annual revenue; allows Attorney General civil enforcement actions for violations.
