H1008 Summary

• Clarifies sex offender registration process by allowing Department of Public Safety to deliver verification forms to Division of Adult Correction for offenders serving sentences exceeding 24 months, and specifies that termination petitions filed under G.S. 14-208.12A must be filed in the district where the offense occurred regardless of current residence (effective August 1, 2022).

• Allows judges to delegate limited authority to probation officers to reduce supervised probation terms by up to one-fourth the original sentence when offenders demonstrate compliance and diligent progress, subject to court approval, victim notification, and restitution payment in full (effective December 1, 2022).

• Permits warrantless searches of individuals on post-release supervision and their vehicles and premises while present for purposes related to supervision, with exceptions for searches that would otherwise be unlawful (effective upon passage).

• Expands rental protections for victims of domestic violence, sexual assault, stalking, attempted homicide, and household members of homicide victims to allow early lease termination with documentation from law enforcement, court, or federal agency (effective August 1, 2022).

• Creates privilege for communications between homicide victims and victim assistance center agents requiring 30+ hours of training, with court-ordered disclosure permitted only upon preponderance of evidence for relevant and material information in civil or criminal proceedings (effective upon passage).

• Removes county restrictions on sheriff contracts for detention facility food purchases; applies to all counties statewide.

• Prohibits impersonation of taxicab drivers and transportation network company drivers as Class H felony if committed during separate felony offense, or Class 2 misdemeanor otherwise (effective December 1, 2022).
