House Bill 143 Summary

• Adds Swain County to the list of counties where sheriff vacancies are filled by county board of commissioners appointment rather than election.

• County coroner executes all sheriff duties until board of commissioners appoints a replacement sheriff for the remainder of the term.

• Board must consult the county executive committee of the sheriff's political party before filling vacancy and shall appoint the party's recommended candidate if made within 30 days of the vacancy.

• Board of commissioners cannot appoint a replacement without first obtaining a valid disclosure statement of no felony convictions or expungements issued within 90 days prior to appointment.

• Act becomes effective upon ratification on September 9, 2021 and applies to vacancies occurring on or after that date.
