Governor's emergency management powers under G.S. 166A-19.30(c) cannot be exercised in Rutherford or Polk Counties without either Council of State concurrence or majority approval from the respective county board of commissioners.

Council of State concurrence requires consensus from a majority of members within 48 hours of contact, with the Governor documenting and publicly releasing each member's response by name and position.

Council of State membership includes the Lieutenant Governor, Secretary of State, Auditor, Treasurer, Superintendent of Public Instruction, Attorney General, Commissioner of Agriculture, Commissioner of Labor, and Commissioner of Insurance.

Any emergency powers already in effect in Rutherford and Polk Counties when the law takes effect expire two calendar days later unless Council of State concurrence is obtained or county board approval is granted.

The act applies only to Rutherford and Polk Counties and becomes effective immediately upon passage for any state of emergency declared by the Governor or General Assembly.
