Allows applicants to exceed allowable density limits in water supply watersheds for preexisting nonresidential developments if stormwater from existing and new built-upon areas is treated according to all applicable laws and regulations and vegetated buffers are preserved.

Prohibits stormwater runoff rules from requiring private property owners to install new or increased stormwater controls for preexisting development or redevelopment that does not remove existing controls.

Limits increased stormwater control requirements during redevelopment to only the amount of new impervious surface that exceeds the impervious surface that existed before redevelopment.

Allows property owners to voluntarily elect to treat all stormwater from preexisting or redevelopment activities to qualify for exceeding allowable density under water supply watershed rules.

Effective November 1, 2021, applies to permit applications and other approvals received on or after that date.
