H228 - Attractive Nuisances

• Adds new exception to landowner liability for bodies of water on their property, limiting liability for child trespassers unless the landowner creates swimming areas or makes other improvements that attract children to the water.

• Defines "body of water" to include pools, ponds, streams, creeks, rivers, lakes, and similar water features used primarily for wildlife habitats, wildlife conservation, irrigation, or livestock watering.

• Maintains existing liability exceptions for intentional harms, artificial conditions meeting specific criteria, and situations where a possessor discovers a trespasser in peril or helplessness.

• Becomes effective October 1, 2021, and applies only to actions filed on or after that date.
