Division of Social Services must submit comprehensive report to Office of Administrative Hearings by May 31, 2022, listing all policies, guidelines, and interpretive statements that affect procedural or substantive rights of non-employees

Commission and OAH shall jointly review the report to identify violations of G.S. 150B-18, with disagreements referred to Rules Review Commission for final determination

Policies identified as violations become interim rules until July 1, 2023, at which point they become void unless adopted as permanent rules by the Commission

New policies, guidelines, or interpretive statements issued after this act becomes effective automatically void one year after issuance unless reissued by Secretary of Health and Human Services (maximum one reissuance allowed)

Commission may file action for declaratory judgment in Wake County Superior Court if it disagrees with Rules Review Commission determinations
