House Bill 333 Summary

• Requires mandatory disciplinary sanctions for University of North Carolina students found to have engaged in property damage (violating G.S. 14-127 or G.S. 14-132(a)(2)) during protests or demonstrations on campus.

• Mandatory sanctions include expulsion or suspension for at least one academic period, revocation of State-funded student financial assistance, and readmission contingent upon restitution for property damage agreed upon between the institution and student.

• Establishes "clear and convincing evidence" as the standard of proof in disciplinary cases involving alleged property damage during protests, and requires students to receive a formal hearing with rights including advance notice, witness confrontation, and right to counsel.

• Requires the Committee on Free Expression to report annually by September 1 on enforcement of mandatory discipline policies, readmittance of suspended or expelled students, and increases in security costs at UNC institutions.

• Effective upon enactment and applies beginning with the 2021-2022 academic year.
