Session Law 2021-181 (House Bill 404) Summary

• Public Safety Answering Points (PSAPs), regional PSAPs, and their employees, agents, and certified law enforcement employees are not liable for civil damages except in cases of gross negligence or wanton/willful misconduct.

• Liability immunity waiver applies when a liability insurance policy covers claims against PSAPs, regional PSAPs, their employees, directors, officers, vendors, or agents, or certified law enforcement agency employees.

• Immunity covers acts related to 911 system development, operation, maintenance, call taking, dispatching, radio operations, data terminal operations, subscriber information release, and emergency-related information requests.

• Immunity does not apply to civil actions arising from motor vehicle operation or ownership by PSAP or law enforcement employees.

• Bill clarifies and amends technical provisions in the No Patient Left Alone Act (S.L. 2021-171) regarding compassionate care visitation in hospitals, nursing homes, hospice facilities, and mental health facilities, conditioning visitation rights on applicable federal health guidelines.
