Prohibits abortion when the physician knows or has objective reason to know that a significant factor in seeking the abortion is the race, sex, or presence of Down syndrome of the unborn child.

Requires physicians performing abortions after the sixteenth week of pregnancy to document the gestational age determination method, whether race, sex, or Down syndrome was detected through genetic testing or ultrasound, and a statement confirming the woman did not seek abortion based on these factors.

Places no affirmative duty on physicians to inquire whether the sex of the unborn child is a factor in the woman's decision to seek an abortion.

Mandates physicians provide documentation to the Department of Health and Human Services for statistical purposes only, with patient and physician confidentiality protected and information kept confidential under HIPAA.

Becomes effective September 1, 2021, and applies to all abortions performed on or after that date.
