Dignity for Women Who are Incarcerated Act

• Prohibits restraints on pregnant women during the second and third trimester, labor, delivery, and postpartum recovery period (six weeks or longer), except wrist handcuffs may be used during postpartum recovery only if an individualized determination finds an "important circumstance" exists.

• Restricts body cavity searches of pregnant women and those in postpartum recovery to certified health care professionals only, and only if probable cause exists that contraband presents an immediate threat to the woman, fetus, or another person.

• Requires facilities to provide pregnant and postpartum women with adequate prenatal nutrition, necessary medical care at no cost, menstrual products at no cost, and hygiene products during recovery.

• Prohibits placement of pregnant women or those in postpartum recovery in restrictive housing unless an individualized determination finds an "important circumstance" exists, and restricts bed assignments to those no higher than 3 feet from the floor.

• Applies to both state prisons and local confinement facilities (jails, lockups, detention centers) and becomes effective December 1, 2021.
