H 635 - Hydraulic Fracturing/Statewide Ban

• Prohibits all state agencies, including the Department of Environmental Quality, Environmental Management Commission, Commission for Public Health, and Mining and Energy Commission, from issuing permits for oil or gas exploration or development using horizontal drilling and hydraulic fracturing treatments

• Removes language from existing statutes that allowed horizontal drilling and hydraulic fracturing for oil and gas exploration and development purposes

• Requires the State Geologist to review hydraulic fracturing fluid chemicals and constituents for compliance with state and federal laws, with written certification required before any drilling commences

• Repeals G.S. 113-415.1, which addressed community choice on oil and gas exploration

• Takes effect immediately upon passage and applies to all permit applications for oil and gas exploration or development activities received by state agencies on or after the effective date
