House Bill 674 Summary

• DNA samples must be obtained from persons convicted or found not guilty by reason of insanity for all felonies, assault on individuals with disabilities, stalking, assault on females by males 18+, assault on children under 12, and domestic violence offenses, effective December 1, 2022.

• Increased maximum reimbursement payments for forensic medical examinations of sexual assault victims from $800 to $1,500, with physician/SANE nurse fees increasing from $350 to $600, hospital fees from $250 to $500, and other eligible expenses from $200 to $400, effective October 1, 2022.

• Medical facilities cannot bill victims, their insurance, Medicaid, Medicare, or other sources for forensic medical examinations and must not seek reimbursement from the program after one year from the examination date.

• County commissioners may authorize the county manager or finance officer to grant refunds for overpaid excise taxes filed within six months, with a right of appeal to the full board.

• Registers of deeds must maintain alphabetical indexes duplicated onto separately kept backup storage media for disaster recovery and operations resumption in case of equipment failure or data loss.
