Requires all public employee first responders (law enforcement officers, firefighters, emergency medical technicians, and other emergency response employees) employed by state agencies or local political subdivisions to execute or produce a valid health care power of attorney.

Requires private employers in North Carolina that employ private employee first responders to mandate that all first responders maintain a valid health care power of attorney for medical decision-making when incapacitated.

Mandates that employing authorities maintain and provide prompt access to copies of first responders' health care powers of attorney for use during emergencies when the responder is incapacitated.

Requires first responders and their supervisors to review the health care power of attorney annually as part of the employing authority's employee performance review process.

Excludes volunteer firefighters from the definition of first responders and becomes effective January 1, 2022.
