Defines "booking photograph" as an image of an individual taken by a law enforcement agency for identification purposes or taken when processed into jail

Classifies booking photographs as confidential records that are not public records and prohibits law enforcement agencies from publishing, distributing, or releasing them

Allows release of booking photographs only when they relate to criminal investigations of missing person reports

Permits courts of competent jurisdiction to order release of booking photographs upon demonstration that disclosure is actually necessary for immediate law enforcement needs

Becomes effective October 1, 2021
