House Bill 801 Summary

• Allows exempt organizations that are tax-exempt under Internal Revenue Code section 501(c)(3) and operate specialized community residential centers for individuals with developmental disabilities to conduct game nights at non-qualified facilities if they obtain a special one-time permit under G.S. 18B-1002(a)(5).

• Requires game night permit applications to be submitted to the Alcohol Law Enforcement Division at least 30 days in advance with a $100 fee per event, and permits must be displayed at the event.

• Limits facilities authorized to host game nights to no more than two game nights per calendar month.

• Requires gaming tables and equipment used in game nights to be registered with the Alcohol Law Enforcement Division with a $25 annual sticker fee per item, and prohibits seizure of properly registered equipment.

• Establishes a $2,500 annual permit fee for game night vendors providing gaming tables or equipment, and disqualifies applicants with gambling law violations, pending gambling charges, active court orders prohibiting gambling, or felony convictions.

• Takes effect July 1, 2021.
