Increases penalties for rioting: Class 1 misdemeanor for basic rioting; Class H felony if property damage exceeds $1,500 or serious bodily injury occurs; Class F felony if person causes such damage/injury; Class E felony if person causes death during riot

Increases penalties for inciting rioting: Class A1 misdemeanor for basic incitement; Class E felony if incitement contributes to riot with property damage exceeding $1,500 or serious bodily injury; Class D felony if incitement causes death

Allows treble damages recovery: Victims of rioting or looting violations may sue for three times actual damages plus court costs and attorneys' fees (applies to both G.S. 14-288.2 rioting and G.S. 14-288.6 looting offenses)

Upgrades assault on emergency personnel penalties during riots or declared emergencies: Class H felony for assault causing physical injury; Class F felony for assault with dangerous weapons or substances

Requires judges to determine pretrial release conditions for rioting and looting charges; defendants may be held up to 48 hours pending judicial determination; judges may order defendants to stay away from specific locations and may consider criminal history

Effective December 1, 2021 for offenses committed on or after that date
