H.B. 91 Summary

• Creates Article 29E of Chapter 115C establishing state-level oversight of public high school interscholastic athletics through the State Board of Education

• State Board must adopt rules governing student participation eligibility, health and safety, penalties, appeals, administrative matters, gameplay, fees, and reporting for interscholastic athletic activities

• State Board may enter into four-year memoranda of understanding with nonprofit organizations to administer and enforce athletic rules, with State Board authority to invalidate rules and require annual independent audits

• If State Board cannot enter into memorandum by March 15, 2022, athletics administration transfers to the Department of Public Instruction for 2022-2023 school year

• Requires participating schools to purchase catastrophic insurance for students and personnel participating in interscholastic athletic activities beginning with 2022-2023 school year, with Commissioner of Insurance offering coverage at established rates
