Commissioner of Agriculture may issue or deny a wholesale distributor license for prescription drugs that is conditioned upon federal approval under section 505 of the Federal Food, Drug, and Cosmetic Act while the federal approval process is pending.

Commissioner must determine whether to issue or deny a license within 90 days after an applicant files an application.

Commissioner shall consider nine evaluation factors when reviewing applications, including applicant's criminal history, prior drug distribution experience, compliance with previous licenses, and employee qualifications in drug handling.

Commissioner must inspect the applicant's facility where prescription drugs will be stored, handled, or distributed before issuing a license.

The law is effective upon passage and applies to all license applications submitted on or after the effective date.
