The Chief Administrative Law Judge gains authority to establish or abolish subordinate positions within the Office of Administrative Hearings, subject to State Budget Act and appropriations limitations.

The Chief Administrative Law Judge may make appointments to subordinate positions, remove appointed persons, transfer employees between positions, and change duties, titles, and compensation of existing subordinate positions.

The Chief Administrative Law Judge and five employees designated by the Chief Administrative Law Judge are exempt from the North Carolina Human Resources Act.

All other employees of the Office of Administrative Hearings remain subject to the North Carolina Human Resources Act.

The act is effective upon becoming law.
