Parents may elect for their child to not wear a face covering while on public school unit property and must notify the school annually of this election, with no requirement to provide reasons or health certifications.

Students without face coverings shall not be treated differently than students with face coverings in classroom assignments, course assignments, non-academic portions of the school day, extracurricular activities, student discipline, or academic grading.

Local boards of education, charter schools, boards of directors, and laboratory schools must comply with parental discretion requirements in G.S. 115C-375.30.

School officials and employees are not liable for any act or omission in compliance with this section unless it amounts to gross negligence, willful or wanton conduct, or intentional wrongdoing.

Repeals Section 10 of S.L. 2021-130 regarding monthly voting requirements on face coverings, effective upon enactment on February 17, 2022.
