Modified utility vehicles must have an overall length of 110 inches or greater (reduced from 142 inches) and overall height of 60 inches or greater (reduced from 70 inches), with engine displacement greater than 2,400 cubic centimeters and maximum speed capability of 40 mph or greater.

Modified utility vehicles may only be operated on streets and highways with posted speed limits of 55 mph or less, with the additional restriction that they cannot operate on highways with four or more travel lanes unless the speed limit is 35 mph or less.

Operators and passengers in modified utility vehicles without windshields and windshield wipers must wear safety helmets complying with Federal Motor Vehicle Safety Standard (FMVSS) 218 with properly secured retention straps.

The Division shall assign vehicle identification numbers to modified utility vehicles that do not have one upon owner application prior to registration.

The Department of Transportation Ferry Division shall lease a passenger ferry vessel for Hatteras-Ocracoke service using $700,000 in nonrecurring Highway Fund appropriations, with lease term ending by August 15, 2021, and any remaining funds deposited to the Ferry Systemwide reserve account.
