Senate Bill 336 Summary

• Requires condominium declarations to include a recorded certificate of completion from a licensed architect or engineer confirming structural components and mechanical systems are substantially completed before the declaration can be recorded.

• Applies specified provisions of the North Carolina Condominium Act (Chapter 47C) to condominiums created on or before October 1, 1986, including sections covering separate titles, taxation, eminent domain, liability, and assessment liens.

• Establishes mandatory restitution for defendants convicted of child sexual exploitation (G.S. 14-190.16, 14-190.17, or 14-190.17A) to cover victim losses including medical care, therapy, transportation, lost income, and attorneys' fees, effective December 1, 2021.

• Exempts condominium covenants, cooperative declarations, and certain planned community provisions from the Marketable Title Act, preventing those covenants from being extinguished by marketable record title claims.
