Government Transparency Act of 2021 - Bill Summary

• Requires state departments, agencies, local boards of education, community colleges, counties, cities, and public hospitals to maintain and disclose public employee records including name, age, employment date, salary, contract terms, position changes, and disciplinary actions.

• Mandates disclosure of date and general description of reasons for promotions, demotions, dismissals, transfers, suspensions, separations, and other position changes within 30 days after employee exhausts all administrative appeals.

• Protects confidential information under HIPAA and the Americans with Disabilities Act; allows agencies to list disclosure as "description of action prohibited by applicable law" when legally required to withhold information.

• For dismissals, requires written notice from department head setting forth specific acts or omissions that are the basis of dismissal to be made public.

• Becomes effective December 1, 2021.
