Senate Bill 360 Summary

• Requires joint approval from the Speaker of the House of Representatives and the President Pro Tempore of the Senate before the Attorney General may enter into consent judgments in disputes challenging North Carolina statutes or constitutional provisions when these legislative leaders have intervened or are named parties.

• Requires the same joint legislative approval for settlement agreements or other agreements that would dispose of disputes challenging state statutes or constitutional provisions when the Speaker and President Pro Tempore are parties or have intervened on behalf of the General Assembly.

• Allows the Speaker and President Pro Tempore to approve agreements through counsel of their choice rather than requiring their personal signatures.

• Applies to consent judgments, settlement agreements, and other dispositive agreements entered on or after the bill becomes law, effective September 16, 2021.
