Senate Bill 470 Summary

• Corrects technical provisions in S.L. 2021-150 ABC omnibus legislation, including changing the effective date for online ABC orders from October 1, 2021 to October 1, 2022.

• Eliminates the 25% gross receipts cap on alcoholic beverage sales for tour boats operating on state rivers and waterways.

• Allows empty spirituous liquor bottles to be used for display purposes in establishments with proper notification to the ABC Commission and mixed beverages tax stamps.

• Reduces the minimum inside dining area seating requirement for restaurants from 36 to 10 people while maintaining the 30% food and nonalcoholic beverage gross receipts threshold.

• Permits malt beverages to be sold in 50-milliliter containers and updates the name of the North Carolina Propane Gas Association to Southeast Propane Alliance, Inc.
