Senate Bill 477: Victims' Fair Treatment Act

• Enacts Chapter 1H establishing a comparative fault system where claimants' damages are reduced by their percentage of responsibility in personal injury and property damage cases.

• Claimants cannot recover any damages if their contributory fault exceeds the combined responsibility of all other parties and released persons.

• Requires courts to determine percentages of responsibility for all parties and released persons based on the nature and causal relation of their conduct to the damages claimed.

• Allows courts to reallocate uncollectible shares from insolvent defendants to other liable parties and released persons within 90 days of judgment.

• Eliminates strict liability in product liability actions and applies comparative fault provisions to product liability, wrongful death, and state tort claims; effective January 1, 2022 for actions filed on or after that date.
