Establishes Chapter 16A of North Carolina General Statutes, creating the "North Carolina Derby Act" to regulate horse racing and develop the equine industry in the state.

Creates the North Carolina Racing Office under the North Carolina Lottery Commission with authority to issue permits for quality racing facilities, assign racing dates, license racing personnel, enforce racing laws, and conduct investigations.

Requires an Executive Secretary to manage the Racing Office, execute Commission rules, maintain records, and perform duties including serving as a potential hearing officer under the Administrative Procedure Act.

Mandates comprehensive definitions for horse racing terms including North Carolina-bred horses, trained horses, stallions, racing facilities, operators, and residents eligible to participate in the racing industry.

Requires all persons involved with horse racing (except general admission patrons) to obtain licenses from the Racing Office; the Commission shall establish license schedules, application requirements, and fees; licenses are nontransferable and may require drug testing waivers.
