Senate Bill 646: Marijuana Justice and Reinvestment Act

• Legalizes cannabis possession and use for adults 21 and older effective January 1, 2022, with possession limits of 2 ounces, 15 grams of concentrate, 2,000 mg THC in products, or 6 plants.

• Establishes regulated cannabis market through Department of Public Safety with licensing for cultivation facilities, manufacturers, retailers, testing facilities, delivery services, and on-site consumption establishments.

• Creates Office of Social Equity with three funds (Community Reinvestment and Repair Fund, Social Equity Fund, Cannabis Education and Technical Assistance Fund) to prioritize participation by communities disproportionately impacted by cannabis prohibition.

• Imposes 20% state excise tax on cannabis sales plus optional 3% local option tax, with revenue distributed to equity funds (38%), substance abuse treatment (7%), public education (2%), cannabis research (2%), and impaired driving enforcement (1%).

• Legalizes medical cannabis with registry identification cards for qualified patients and designated caregivers, and automatically expunges convictions for cannabis offenses legal under the new law by July 1, 2024.
