Adds Section 39 to Article 1 of the North Carolina Constitution to prohibit the state, political subdivisions, public schools, and public higher education institutions from discriminating against or granting preferential treatment based on race, sex, color, ethnicity, or national origin in public employment, public education, and public contracting.

Allows bona fide qualifications based on sex that are reasonably necessary to the normal operation of public employment, public education, or public contracting.

Permits actions necessary to establish or maintain eligibility for federal programs where ineligibility would result in loss of federal funds to the state.

Requires submission of the amendment to qualified voters at the 2022 statewide primary election, with certification by the State Board of Elections if approved by a majority of votes cast.

Amendment becomes effective upon certification and applies to actions taken on or after the effective date; does not invalidate existing court orders or consent decrees in force at the time of certification.
