Directs the North Carolina Department of Health and Human Services (DHHS) to seek federal approval to allow parents to retain Medicaid eligibility while their child is temporarily in foster care.

Allows parents to maintain Medicaid coverage if they have lost legal custody of a child under Chapter 7B of the General Statutes, the child is in state-sponsored foster care or receiving Title IV-E foster care assistance, and the parent is making reasonable efforts to comply with a court-ordered reunification plan.

Requires parents to continue meeting existing family income requirements under Medicaid subdivision (1) or (2) to retain eligibility under the new criteria.

Implementation is contingent upon approval from the Centers for Medicare and Medicaid Services (CMS) through a 1115 waiver or other federal authority, with CMS approval required by June 30, 2023, or the provision expires.

Becomes effective upon CMS approval and appropriate General Assembly appropriation of implementation funds.
