H1001 - Right to Use Contraception Act

• Establishes a statutory right for individuals to obtain and use contraceptives and for health care providers to provide contraceptives and contraception-related information in North Carolina.

• Defines contraception broadly to include oral contraceptives, intrauterine devices, hormonal implants, emergency contraceptives, condoms, injectables, barrier methods, patches, and vaginal rings that are FDA-approved.

• Prohibits the State, cities, and counties from enforcing laws that restrict the sale, provision, or use of FDA-approved contraceptives or that make contraceptives harder to access than other medically similar drugs or devices.

• Allows the Attorney General and individuals or entities affected by violations to bring civil actions, with courts authorized to set aside violating laws and award injunctive relief if a violation is found.

• Appropriates $3,000,000 in nonrecurring state funds for the 2024-2025 fiscal year to expand education programs for the NC Medicaid Family Planning Program ("Be Smart"), matched with $3,000,000 in federal funds.
