Local educational agencies must make available a parent's choice of nurse when providing nursing services required by a child's individualized education program (IEP), subject to five conditions.

The parent's chosen nurse must have previously provided nursing services to the child either before the IEP required them or before the child enrolled in the current school.

The parent's chosen nurse must be employed by a nursing agency that meets all standard contract terms, including licensing and liability requirements, and charges a rate equal to or less than other contracted nurses.

The provision does not limit the local educational agency's responsibility to provide a free appropriate public education under special education law.

The act is effective upon enactment and applies beginning with the 2023-2024 school year.
